Racial and Ethnic Disparity and Criminal Justice - 3054 Words
Racial and Ethnic Disparity and Criminal Justice: How much is too much? In this article, Robert, April, and Jorge (2010) acknowledges previous research reports on this topic and reveals that race, and racial patterns have found their way in involvement of crime. However, Robert, April, and Jorge (2010) argue that there is no significant proof that there are meaningful racial disparities in the legal systems. Although some literatures provide research on the existence of racial profiling by police, in imprisonment, and sentencing, other researchers report no significant racial disparities in the legal systems (Black and Reiss, 1970; Pilivian and Briar, 1964). However, other researchers report on ample racial disparities based on race. These researches are controversial because the size of the differences in such reports tends to bring up the question of meaningfulness of the differences observed (Wilbanks, 1987). During the Antebellum period, the American legal system witnessed disparity when there was a massive movement of African Americans out of the rural cities to the urban areas (Crutchfield and Finke, 1983). Another research in other parts of America, prior to the civil war, many whites was imprisoned (Robert, April, and Jorge, 2010). Prior literature on the convict lease systems in postbellum south that aimed at replacing slavery also practiced racial disparity, seen during the using of blacks to work in the field they had worked before as slaves (Adamson 1790-1835;Show MoreRelatedRacial Inequality919 Words à |à 4 PagesWhat is racial inequality? I Am A Visual Learner - 1124 Words
I have known for quite some time that I am a visual learner. It is much easier for me to grasp a concept if I am shown how to do something by demonstration rather than reading instructions. I become very frustrated rather quickly if I have to rely solely on written instructions. When I become frustrated, I tend to be easily distracted and focusing becomes an issue. How people take in information and the decisions they make or conclusions they come to about that information is their learning style. A learning styles assessment can be taken to determine the way in which individuals learn best. One such assessment is the VARK Inventory. John N. Gardner and Betsy O. Barefoot, authors of Your College Experience define this inventory as follows, ââ¬Å"The VARK inventory, a sixteen-item questionnaire, focuses on how learners prefer to use their senses (hearing, seeing, writing, reading, experiencing) to learn. The acronym VARK stands for ââ¬Å"Visual,â⬠ââ¬Å"Aural,â⬠â⠬Å"Read/Write,â⬠and ââ¬Å"Kinestheticâ⬠(70). A visual learner prefers seeing, an aural learner prefers listening, a read/write learner prefers their information be presented in written form and kinesthetic learner prefers a hands-on learning approach. Racism Is Still Booming in the U.S. Essay - 599 Words
Feeling unwanted can be the most heartbreaking sensation to experience, but being told that you donââ¬â¢t belong because of something as simple as race is infinitely more crushing. In the US, this is still very common; and not just against one race. There are many towns, even states that are considered oriented towards one race. This is especially horrid because people try to say that racism is a thing of the past, when the truth is nearly the opposite. For example, if a white-black mixed couple were to display affection in public, chances are that they would either be shunned or given dirty looks and/or snarky remarks. Also, another big factor that keeps racism going is the fact that it is considered okay for certain races to say wordsâ⬠¦show more contentâ⬠¦Racism in the Media In most areas of the media, racist comments are taken one of two ways; either they are considered extremely offensive, or taken as nothing more than a joke. Itââ¬â¢s understandable for people to make jokes so that they may ease tension and possibly make friends, but if it is socially acceptable for one race to make fun of itself, would it not be acceptable for them to crack a joke or two about another? If not, then why is it acceptable for them to make fun of their own race? However, these kind of questions arenââ¬â¢t applied to the media unless to persecute celebrities for doing the same things that other celebrities still do; but the difference is that the people who say offensive things about their own race arenââ¬â¢t deemed racist. If one were to pay attention to the lyrics of most hip-hop/rap music, they would find that there are many racial slurs. But because the artists who wrote said slurs are using them against their own race, it isnââ¬â¢t considered racist. For example, according to an essay written by Bennie M. Currie, if a black man were to call another black man the ââ¬Å"Nâ⬠word, it would be the same as calling him a brother. But on the other h and, if a white man were to say the ââ¬Å"Nâ⬠word in any context, it would be taken to the highest offence. However, she also asks whether there is any building works in that area because for her meditation business she requires silence. Employee of council breach section 60 of the ACL, which means employee fail to give service with care, and this cause severe loss to the Ellen. Therefore, there is breach of ACL and Ellen can file claim of compensation. Conclusion: There is breach of section 60 of ACL and Ellen can file claim of compensation. 2.Issue: Whether Ellen breach the contract signed between her and landlord by not paying the rent? Law: There are number of cases in which contract will brought to an end because of any supervening event which is not in the control of parties. This can be understood through case law Taylor v Caldwell (1863) 3 B S 826. This case was considered as fundamental case in the area of frustration in context of contract law. In this case, Murray states that rule of frustration were developed to alleviate harshness in terms of absolute original rules. Frustration is related to those situations when Court discharges the obligations which are stated under the contract and this means that parties of the contract are not bound to perform the contract. It must be noted that, this doctrine is applied in limited rage of circumstances, and usually it includes those events which are fundamentally different from those events which are anticipated by the parties. Courts do not provide relief under frustration rule if events are already assumed by the parties and provide parties in their contract. In common law when frustration is established then contract is terminated on automatic basis, and there is no option to discharge the contract, and in common law loss lies on that side where it falls. When frustration is established then then contract is automatically terminated, and there is no option to discharge and perform the contract. There is no option to discharge the contract when contract is discharged by frustration (ACL, n.d.). Application: In the present case, Ellen fails to pay the rent of the premises because of the failure of her business, and this failure cause because of the disruptive noise result from the building work carried at next door. This noise also caused nervous disorder to the Ellen. Because of the building work and for avoiding the noise, Ellen reduces the working hours which reduce the utility of the business and result in lack of payment of rent. In this Ellen does not breach the contract because event occurred are not anticipated by the parties and failure cause because of frustration. Therefore, there is no breach of contract and contract is discharged by frustration. Conclusion: Ellen is not liable for breach of contract because contract is discharged by frustration and there is no liability of Ellen towards the landlord. 3.Issue: Whether statement made by employee of council is considered as misstatement under tort of negligence? Law: A tort is defines as act or omission which is wrongful in nature, and it also give right to other party to take civil action for the wrongful act or omission committed by other party. On the other hand, negligent misstatement is defined as an statement which is inaccurate in nature and made honestly but carelessly. Generally, it is made in the form of advice given by party who has special skill and knowledge to the other party who does not possess special skill and knowledge. This can be understood through case law Hedley Byrne Co Ltd v Heller Partners Ltd [1964] AC 465. It is an English tort law under which pure economic loss cause to another party because of negligent misstatement made by one party. In this case, Court further states that relationship between the parties must be such as it creates duty of care, and there must be reasonable grounds to ensure that information given by person must be of such nature that person reasonably relied on the information. Application: In the present case, asks whether there is any building works in that area because for her meditation business she requires silence. While answering this question, employee of the council stated that everything is alright and there is nothing to worry. This statement is considered as negligent misstatement because in this Ellen suffers pure economic loss by relying on the statement made by employee carelessly.
